Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Summitview Land Holdings, LLC ("we", "us", "our") governing your use of the Daily Suspect mobile application (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service. This license is for your personal, non-commercial entertainment use only.

2. The daily case is free

The daily case is available at no cost. Optional purchases described below unlock additional content and cosmetic options; they are never required to play the free daily case.

3. Subscriptions (Detective's Archive)

The App offers an auto-renewable subscription — the Detective's Archive — that unlocks past cases. It is offered on a monthly or yearly basis at the price shown in the App at the time of purchase.

• Payment is charged to your Apple Account at confirmation of purchase.
• The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price of the selected plan.
• You can manage or cancel your subscription at any time in your Apple Account settings (Settings → your name → Subscriptions). Cancellation takes effect at the end of the current billing period.

4. One-time purchases

The App also offers non-consumable one-time purchases: a Lifetime unlock of the Detective's Archive, and cosmetic themes. These are charged once to your Apple Account and do not renew. Cosmetic themes change only the App's appearance and confer no gameplay advantage.

5. Restoring purchases

Purchases are tied to your Apple Account and can be restored on your devices using the "Restore Purchases" option in the App, subject to Apple's rules.

6. Refunds

All purchases are processed by Apple. Refund requests are handled by Apple in accordance with its policies; we are not able to issue refunds directly. You can request a refund at reportaproblem.apple.com.

7. Intellectual property

The App, including its cases, artwork, text, logic engine, and design, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the App except as expressly permitted by law.

8. Acceptable use

You agree not to misuse the App, interfere with its normal operation, attempt to circumvent purchase or access controls, or use it in violation of any applicable law.

9. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the App will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the App. Our total liability shall not exceed the amount you paid for the App or the purchase giving rise to the claim in the twelve months preceding it.

11. Apple as third-party beneficiary

These Terms are between you and us, not with Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles, except where preempted by applicable federal law or the rules of the App Store.
